1. Acceptance of Terms

Welcome to BioMedicineHealth ("Platform," "we," "us," or "our"), operated by Sunkar Technologies, LLC. By accessing or using our telehealth services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Medical Disclaimer

IMPORTANT MEDICAL NOTICE:

  • Our services are NOT for medical emergencies. Call 911 for emergencies.
  • Telehealth consultations supplement but do not replace in-person care.
  • Not all conditions can be diagnosed or treated remotely.
  • Providers may require in-person follow-up or referrals.

3. Eligibility

You must:

  • Be at least 18 years old (or have parental/guardian consent)
  • Provide accurate and complete registration information
  • Be physically located in a state where our providers are licensed
  • Comply with all applicable federal and state laws

4. Provider-Patient Relationship

a) Independent Contractors: All healthcare providers on our Platform are independent contractors, not employees of Sunkar Technologies, LLC. We do not practice medicine.

b) State Licensing: Providers are licensed to practice only in specific states. You may only consult with providers licensed in your current physical location.

c) Standard of Care: Providers maintain professional liability and follow all state medical board regulations.

5. Prescriptions & Controlled Substances

  • Prescriptions are issued at provider discretion based on medical necessity
  • We do NOT prescribe DEA Schedule II controlled substances (e.g., opioids, stimulants)
  • Some states prohibit certain telehealth prescriptions—providers will inform you
  • Prescriptions are sent electronically to your chosen pharmacy

6. Payment & Billing

a) Fees: Consultation fees are displayed before booking. Membership plans may offer discounts.

b) Insurance: We may accept insurance; coverage is not guaranteed. You are responsible for co-pays and deductibles.

c) Refunds: No-show appointments and late cancellations (<24 hours) are non-refundable. Refunds for technical issues are evaluated case-by-case.

7. HIPAA & Privacy

We comply with the Health Insurance Portability and Accountability Act (HIPAA). Your Protected Health Information (PHI) is handled according to our Privacy Policy and HIPAA Notice of Privacy Practices.

8. Video Consultation Requirements

  • Stable internet connection (minimum 1 Mbps upload/download)
  • Camera and microphone enabled
  • Private, well-lit location
  • Audio-only consultations may be permitted at provider discretion

9. Prohibited Uses

You may NOT:

  • Provide false or misleading health information
  • Use the Platform for illegal purposes (e.g., drug-seeking behavior)
  • Harass, threaten, or abuse providers or staff
  • Share your account credentials
  • Record video consultations without provider consent

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Sunkar Technologies, LLC is NOT liable for medical outcomes, diagnoses, or treatment decisions
  • We are not responsible for provider negligence or malpractice (providers carry their own insurance)
  • Our liability for Platform technical issues is limited to fees paid in the last 12 months

11. Arbitration & Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, in the state of [YOUR STATE]. You waive the right to a jury trial or class action lawsuit.

12. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or Platform notice.
